SUMMARY:Special Topics in Domestic Violence Law
DESCRIPTION:DESCRIPTION\nThis annual October training is an opportunity to train our volunteer attorneys as well as recruit new attorneys into the Project Together program during Domestic Violence Awareness Month. Since its inception in 1997\, Project Together’s primary focus has been aimed at recruiting\, training\, and coordinating volunteer lawyers to represent indigent clients referred to the Wake County Volunteer Lawyers program at Legal Aid\, in matters involving domestic violence protective orders (“50B hearings”). Project Together (PT) involves collaboration among volunteer attorneys\, the Wake County Volunteer Lawyers Program\, the Domestic Violence Unit at Legal Aid\, and InterAct. \nThis year’s training will include 3.25 hours of general CLE credit for attorneys and paralegals (pending approval by the North Carolina State Bar) and will focus on more advanced areas in domestic violence law. We will provide education on how and when gun prohibitions are triggered with entry of a DVPO and/or when defendants are convicted of certain crimes in NC. We also will look at how to consider safety planning when a client expresses fear and facts indicate that the abuse is still happening during your representation. We will hear from District Court Judges in Wake County on the latest trends and issues DV Civil Court. Finally\, we learn about the options under the law to have a child as a plaintiff or when a custodian files “on behalf of” a child in a domestic violence protective order case and the impact of a temporary custody order in that case. \nWe will be serving heavy hors d’oeuvres (including vegetarian options) and providing materials including the Legal Aid DV Manual for attendees. The manual contains detailed instructions on how to best represent our clients as well as gives a background on domestic violence.
