Through the Disaster Legal Services Hotline (1-833-242-3549) over 150 clients already have been paired with an attorney volunteer for disaster-related legal assistance. The vast majority of Hotline callers have questions and legal needs related to housing issues — landlord/tenant questions\, repairs\, and initial FEMA or insurance claims. \nDuring this training\, pro bono attorney volunteers will learn more about how best to assist Disaster Legal Services Hotline callers with housing-related questions and legal needs. SUMMARY:Special Topics in Domestic Violence Law
DESCRIPTION:DESCRIPTION\nThis annual October training is an opportunity to train our volunteer attorneys as well as recruit new attorneys into the Project Together program during Domestic Violence Awareness Month. Since its inception in 1997\, Project Together’s primary focus has been aimed at recruiting\, training\, and coordinating volunteer lawyers to represent indigent clients referred to the Wake County Volunteer Lawyers program at Legal Aid\, in matters involving domestic violence protective orders (“50B hearings”). Project Together (PT) involves collaboration among volunteer attorneys\, the Wake County Volunteer Lawyers Program\, the Domestic Violence Unit at Legal Aid\, and InterAct. \nThis year’s training will include 3.25 hours of general CLE credit for attorneys and paralegals (pending approval by the North Carolina State Bar) and will focus on more advanced areas in domestic violence law. We will provide education on how and when gun prohibitions are triggered with entry of a DVPO and/or when defendants are convicted of certain crimes in NC. We also will look at how to consider safety planning when a client expresses fear and facts indicate that the abuse is still happening during your representation. We will hear from District Court Judges in Wake County on the latest trends and issues DV Civil Court. Finally\, we learn about the options under the law to have a child as a plaintiff or when a custodian files “on behalf of” a child in a domestic violence protective order case and the impact of a temporary custody order in that case. \nWe will be serving heavy hors d’oeuvres (including vegetarian options) and providing materials including the Legal Aid DV Manual for attendees. The manual contains detailed instructions on how to best represent our clients as well as gives a background on domestic violence. SUMMARY:Community-Based Strategies and Lawyering in the Wake of Natural Disasters
DESCRIPTION:Communities impacted by natural disasters often face fundamental decisions about recovery and rebuilding. Empowering communities with knowledge about their legal rights in this process means providing them with timely and relevant information. This webinar will highlight strategies used by two community-based groups working with disaster survivors and will feature examples of public participation and community engagement within the disaster context. \nSpeakers: \nAriadna Godreau-Aubert and Mariel Quiñones Mundo\, Ayuda Legal Puerto Rico\nJean-Luc Adrien\, Equal Justice Works\, Disaster Recovery Legal Corps Fellow – Community Justice Project\nThis webinar is designed for the Equal Justice Works Disaster Recovery Legal Corps fellows but all advocates and attorneys interested in learning more about this topic are welcomed to join. \nA collaboration between Pro Bono Net\, Lone Star Legal Aid\, and the Equal Justice Works Disaster Recovery Legal Corps. \nAriadna M. Godreau Aubert is a human rights lawyer. She obtained her JD from the University of Puerto Rico School of Law and a Master’s in Law degree in International Human Rights Law at the University of Oxford\, UK. Ariadna has worked in several access to justice initiatives\, which include strategic litigation at local and international levels\, the use of technology to increase legal literacy and organizing movement lawyers. She is the coordinator of the Access to Justice Working Group and the Executive Director of Ayuda Legal Puerto Rico\, Inc. Ariadna is also an adjunct professor at the Universidad de Puerto Rico\, where she teaches courses on human rights\, political theory and international relations. Her academic scholarship revolves around human rights\, gender\, austerity and the right to protest. Her first book\, “Las propias: Apuntes para una pedagogía de las endeudadas” was published on March 2018. \nJean-Luc Adrien is an Equal Justice Works Disaster Recovery Fellow at the Community Justice Project. Jean-Luc uses a community and movement lawyering approach to serve community members and community groups in the context of disaster recovery legal services. He was previously a member of The Bronx Defenders’ Family Defense Practice\, representing and defending parents in Bronx Family Court. Born in Haiti and raised in South Florida\, Jean-Luc received his J.D. from New York University School of Law\, where he was a Root-Tilden-Kern Public Interest Scholar and a Sinsheimer Service Scholar\, and his B.A. in Political Science and Anthropology\, with a Minor in Spanish\, from the University of Florida. During law school\, Jean-Luc participated in the Equal Justice & Defender Clinic and the Juvenile Defender Clinic\, and interned at The Bronx Defenders and the Community Justice Project\, where he participated in the Bertha Justice Institute Ella Baker Program. Prior to law school\, Jean-Luc taught high school Spanish in the Mississippi Delta.

SUMMARY:Better Serving Older or Disabled Veterans: A Special Session on the Intersections Between Veterans Benefits\, Social Security\, and Medicaid (FREE)
DESCRIPTION:Why You Should Attend\nWell over one-half of the American Veteran population is elderly or disabled and entitled to a wide-range of government benefits— from income to health care to in-home services. These benefits can help a veteran and their family stave off poverty\, prolong independence\, and receive the supportive services they need to thrive. Yet\, while many elder law\, disability rights\, and benefits practitioners are versed in Social Security and Medicaid\, few attorneys are aware of how these benefits intersect with benefits from the Department of Veterans Affairs. \nAs part of PLI’s Advocating for Veterans series\, this free half-day session will empower practitioners with the tools they need to maximize their Veteran clients’ income and well-being\, and to better meet their health care and long-term needs. More specifically\, expert veterans and government benefits attorneys will provide practitioners with an in-depth understanding of the Department of Veterans Affairs’ lesser known Non-Service-Connected Pension benefit and break down the interplay between VA Benefits\, Social Security benefits\, Medicaid\, and In-Home Supportive Services. \nWhat You Will Learn\n• How to determine whether a Veteran is eligible for VA Non-Service-Connected Pension\, including how to reduce a Veteran’s countable income in order to ensure entitlement and maximize income\n• How VA Benefits and Social Security benefits intersect\, including how they offset one another\, the main differences between VA Non-Service-Connected Pension and SSI\, and the impact of VA Non-Service-Connected Pension on SSI\n• How to prolong a Veteran’s independence by using VA Non-Service-Connected Pension with or without In-Home Supportive Services to pay for in-home care and assisted living\n• How to expand a Veteran’s long-term care options using VA Benefits\, Medicaid\, and In Home Supportive Services \nWho Should Attend\n• Attorneys and advocates that work with or are interested in serving American Veterans will benefit from this program.\n• Elder law\, disability rights advocates\, and government benefits advocates may find the session particularly applicable to their practice areas.\n• IMPORTANT! If you are a VA-accredited attorney and have already completed the VA’s initial CLE requirement\, this program may satisfy the VA’s continuing CLE requirement to maintain accreditation.\n1. Within 12 months after accreditation\, you are required to complete three hours of qualifying CLE. This program does not satisfy that initial CLE requirement. However\, PLI offers another free program that does meet the initial CLE requirement: Advocating for Veterans: The Basics on VA Benefits\, Discharge Upgrades and Veteran Cultural Competency 2017\n2. Once an attorney has completed their initial CLE requirement\, the VA requires ongoing CLE to maintain accreditation. This program does satisfy the VA’s CLE requirement that accredited attorneys complete an additional three hours of CLE not later than 3 years from the date of initial accreditation and every 2 years thereafter.\n3. Attorneys and other advocates who become accredited will be listed on a national VA list\, and are entitled to represent veterans in their claims for benefits\, on a pro bono basis\, and for attorney’s fees on appeals\, where they are available.\n4. For additional information\, please see the FAQ page on the VA’s Office of General Counsel website.\n• Pursuant to 38 C.F.R. § 14.629(b)(1)(iii) and (iv)\, To maintain accreditation\, agents and attorneys are required to complete an additional 3 hours of qualifying CLE on veterans benefits law and procedure not later than 3 years from the date of initial accreditation and every 2 years thereafter.
